Terms of Service

These terms are the agreement between you and DDL Ventures for the MakeMe app. By downloading it, opening it, or subscribing, you agree to them. If you do not, please do not use MakeMe.

1. What MakeMe does

You give MakeMe a photo, a video, or a link to a post. It uses AI to work out the makeup in it and gives you back a breakdown: the steps in the order they were done, the products it believes were used, close matches you can actually buy, and a routine you can follow. You can save looks, keep a shop of products you want, build routines, and ask Makey questions about your own looks.

We may change, add, or remove features as the app improves. If we ever retire something you paid for, section 4 says what happens to your money.

2. Who may use it

You must be at least 13. If you are under 18, you may use MakeMe only with a parent or guardian's permission, and they are responsible for your account and any purchase made on it. You must not use MakeMe if a previous account of yours was terminated for breaking these terms.

3. Your account

You sign in to MakeMe when you first open it, so your looks have somewhere to live and follow you to a new phone. That is a one-time code sent to your email, Sign in with Apple, or Google. Keep your email, Apple and Google accounts secure; anything done through your MakeMe account is treated as done by you.

4. Subscriptions and billing

MakeMe is subscription only. Past the intro, an active subscription is what opens the app. There is no free tier.

• The plans. MakeMe Pro is an auto-renewing subscription, sold as a one-week plan or a one-year plan, and either one opens every feature in the app. In the United States the weekly plan is US$4.99 and the yearly plan is US$49.99. Elsewhere the price is the App Store's equivalent for your country. Whatever it is, the price, the length of the plan, and the fact that it renews are all shown on the paywall in your own currency before you buy, and the price you agreed to there is the price you pay.
• The free trial. The yearly plan starts with a one-week free trial, once per account and once per phone (and in the App Store, once per Apple Account). An account or a phone that has already had a trial is offered the yearly plan without one. Nothing is charged when the trial starts. At the end of the week it becomes a paid year at the yearly price unless you cancel before then, and the app tells you the length, the price and the renewal before you start it. The weekly plan has no trial, and there is no free tier: past the trial, nothing opens the app but a paid subscription.
• Payment. Payment is charged to your Apple Account when you confirm the purchase. We never see or hold your payment details.
• Automatic renewal. Your subscription renews automatically for the same period at the same price unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before the period ends.
• Cancelling. Cancel any time in Settings › your name › Subscriptions on your iPhone. Cancelling stops the next charge; it does not shorten the period you have already paid for, and the app stays open until that period ends. Deleting the app does not cancel a subscription.
• Refunds. Apple handles all refunds, under Apple's own policy — we cannot issue one. Ask at reportaproblem.apple.com. Where the law gives you a right to withdraw or a refund, that right stands regardless of this paragraph: consumers in the EU and UK, for instance, normally have fourteen days to withdraw from a distance contract, which you exercise by telling us or Apple.
• Price changes. If we change the price of a plan you are on, Apple will tell you and ask you to agree before the new price is charged. If you do not agree, your subscription simply ends at the next renewal.
• Offers. Closing the paywall may show a discounted yearly plan. In the United States this plan costs US$39.99 a year, has no free trial, and renews at the same price unless you cancel. Elsewhere the App Store shows the price in your currency. The price and renewal terms appear before you confirm your purchase. Offers can be withdrawn.
• Refusing an offer. Declining every plan means the app does not open. Nothing is charged and nothing is kept from you: your answers stay in your account, and subscribing later opens the app exactly where you left it.

Apple's rules govern these purchases, their renewal, their cancellation and their refunds.

5. What you send us

You keep every right you already have in the photos, videos, links and words you put into MakeMe. You give us a limited, non-exclusive, worldwide, royalty-free licence to store, copy, process and transmit that content only to run the app for you: to analyse a look, to show it back to you, and to keep it in your library. That licence ends when you delete the content, and it lets us do nothing else with it.

We do not use your photos or videos to train AI models, ours or anyone else's, and we do not licence them onward.

You promise that you have the right to send us what you send: that it is your own photo, or one you are allowed to use, and that submitting it breaks no law and no one else's rights. A link you paste is subject to the terms of the site it points to, and it is your responsibility to respect them.

6. What you must not do

• Upload anyone's photo without their permission, or anything sexual involving a minor, or anything illegal, hateful, or made to harass someone.
• Use MakeMe to identify a person, to build a face database, or for surveillance of any kind.
• Resell, redistribute, or make a competing service out of MakeMe's output; scrape it; or use it to train a model.
• Share an account, or try to reach paid features without paying — by tampering with the app, faking a receipt, or otherwise.
• Break, overload, or reverse-engineer the app or the service behind it, or get around a rate limit.

We can suspend or close an account that does any of this, without a refund for the period in progress where the law allows.

7. What the breakdown is, and is not

8. Brands, products and affiliate links

MakeMe names real brands and products so you can find them. Those names and trademarks belong to their owners, and are used only to describe what a look is made of. MakeMe is not affiliated with, endorsed by, sponsored by, or speaking for any brand it names.

Some "Buy" links are affiliate links, and we may earn a commission at no extra cost to you if you buy through one. A commission never changes what the app recommends: matches come from what the look actually needs. As an Amazon Associate, MakeMe earns from qualifying purchases. What you buy is a contract between you and that retailer, on their terms, and we are not a party to it and not responsible for it.

9. Our intellectual property

The app, its design, its wording, its artwork and everything behind it belong to us and are protected by copyright and trademark law. Your subscription buys you a personal, non-transferable, non-exclusive right to use MakeMe on devices you own, for yourself. It buys you nothing else, and nothing here transfers ownership of anything to you.

The breakdowns MakeMe produces for you are yours to use for yourself — post one, print one, follow one. Section 6 covers what you may not do with them.

10. Copyright and other intellectual property complaints

If you believe something in MakeMe, or something a user sent to MakeMe, infringes your copyright or another right you own, write to Support@trymakeme.com with "IP complaint" in the subject. That address is our designated agent for these notices.

Tell us: what the work is, where in MakeMe you saw it, how to reach you, a statement that you believe in good faith the use is not authorised by the owner or the law, and a statement under penalty of perjury that what you have told us is accurate and that you are the owner or are authorised to act for them. Sign it, electronically or otherwise. We act on notices that check out, and we close the accounts of people who infringe repeatedly. If your material was removed and you believe that was a mistake, write to the same address and we will look again.

11. Feedback

If you send us an idea, a bug report, or a suggestion, we may use it to improve MakeMe without owing you anything for it and without keeping it confidential. You are not giving up any right you already hold in something you separately own; you are simply letting us act on the suggestion. Please do not send us anything you consider secret.

12. Ending it

You can stop using MakeMe at any time, cancel in the App Store, and delete your account in the app's settings. We can suspend or end your access if you break these terms, if we are legally required to, or if we discontinue MakeMe altogether — and if we discontinue it, we will tell you first and you will not be charged again.

Sections 5, 7, 8, 9, 10, 11, 13, 14, 15, 16 and 18 survive the end of this agreement.

13. No warranty

MakeMe is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the app will be uninterrupted, timely, secure, error-free, or that its analysis will be accurate. Some places do not allow these exclusions, and where that is so, this section applies to you only as far as it legally can.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, for lost profits, or for lost or corrupted data. Our total liability to you for any claim relating to MakeMe is limited to the greater of the amount you paid us in the twelve months before the claim, or $50.

Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit. If you are a consumer, your statutory rights are unaffected.

15. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from content you submitted, from your use of MakeMe in breach of these terms, or from your breach of anyone else's rights.

16. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and the state and federal courts sitting in Wyoming have exclusive jurisdiction. If you are a consumer in the EU or UK, you keep the protection of the mandatory law of the country you live in, and you may bring a claim in your own local courts.

Before either of us files anything, please write to Support@trymakeme.com and give us thirty days to put it right. Most things end there. There is no arbitration clause and no class-action waiver in these terms: you keep every court, including a small claims court, that would otherwise be open to you.

17. Apple

MakeMe is licensed, not sold, to you, and these terms are between you and us, not between you and Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for MakeMe — for that, email Support@trymakeme.com. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price; beyond that, Apple has no other warranty obligation, and any claim about the app — product liability, a failure to meet a legal requirement, a consumer protection claim, or an allegation that it infringes someone's intellectual property — is our responsibility and not Apple's. You confirm that you are not in a country under a US embargo or designated as supporting terrorism, and that you are not on any US list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. The rest

If a part of these terms is unenforceable, the rest stays in force. Not enforcing something once does not waive it. You may not transfer this agreement; we may transfer it as part of a sale or merger of the business. Together with the Privacy Policy this is the whole agreement between us about MakeMe.

We may update these terms. If a change matters, we will tell you in the app before it takes effect, and using MakeMe after that means you accept it.
